- Abstract
- the article analyzes the reasons the introduction in Russia of a moratorium on executions vessels with capital punishment, and then a temporary ban on the death penalty. The conclusion is that the courts of general jurisdiction, there is no legal impediment to using the death penalty under the Criminal Code of the Russian Federation. The fi nal decision to abolish the death penalty should adopt the legislative branch, not the Constitutional Court.
