Abstract
in the article analyzes the problem of implementation at the legislative and theoretical levels of the constitutional principle on generally recognized principles and norms of international law and international treaties as part of the legal system of Russia. The situation in the 90-th years of the previous century and in the first decade of the current century is being compared. It is noted that the legislation and the doctrine are behind the practice (especially judicial) in the understanding of its content, which is not conducive to full and accurate implementation of one of the foundations of the constitutional system of the country.
