- Abstract
- The Russian and in the broader context Post-Soviet theory of judicial review at thepre-judicial stages of criminal procedure is likely to be more of a result of interior doctrinal evolution than a comparative influence. But taking into consideration the very difficult choice of an adequate model of criminal procedure for Russia ans some other Post-Soviet countries, could this theory be considered as universal for all modern western criminal procedure's models, both Anglo-American and Continental? According to author's analysis from geopolitical, conceptual and technical point of view, the answer has to be negative, because of two hypothetical methods to legitimate the police functions in the criminal procedure: the omnipotence of the judiciary (for example France) and the police autonomy (for example US). Only the latter is theoretically compatible with the Russian and Post-Soviet conceprion of judicial review, wich should be for this reason rethinking.
