- Abstract
- The article discusses the problem of accusational trend in court practice of electing restraint measure in custody form on the basis of current law enforcement practice. Reasons of accusational trend existence in Russian court practice are formulated. Certain deviations from standard model of judicial control are reviewed, entailing breach of constitutional right to freedom and security to person.
