- Abstract
- the important problem of criminal law theory is to promote correct (fair, reasonable and effective) law enforcement in the conditions of crisis of legal system. The judicial and police discretion on question of fact in many cases allows to provide correct application of inaccurate statutes. Correct interpretation (including restrictive and broad interpretation) of incomprehensible legal texts allows to avoid its incorrect execution. Juristic writings and judicial decisions allow to eliminate legal uncertainty without using analogy.
