Legal regulation of Private International Law includes in itself relevant statutes accumulation. Inheritance law regulated by testamentary statute, the law of obligations – by statute of obligations. Inheritance by contract institutions include both testamentary statute and statute of obligations. Due to the difference in the areas of legal regulation it’s necessary to find out the capacity of these statutes and order their application in the situation of the inheritance by contract institutions law enforcement and implementation. To realize this intention it’s necessary to distinguish a specific legal category – the law of hereditary obligations and, using analysis isolate and create specific statute, which applies only in situation of the inheritance by contract. Also this article proofs necessity for specific legal regulation creation.
