- Abstract
The article deals with the problematic issues of mutual influence of scientific and technical progress (hereinafter – the STP) on the overall organizational and legal mechanism of justice. It is noted that the very development of the STP causes in life the appearance of qualitatively new types of conflicts, disputes, violations of rights and legitimate interests and offenses, including crimes: committed with the usage of digital technologies; in the sphere of transplantology of human organs and tissues; related to the unlawful use of special scientific and technical means for secret obtaining information and many others, this, in turn, requires an adequate – with the use of the achievements of the STP – development of various parts of the justice mechanism, not only in the field of technology. It is necessary to improve the judiciary component (the deepening of specialization), the judicial component (the improving procedural techniques, including through a certain displacement of the goal-setting trial) and, especially, the judicial and status component of the mechanism. Here it is justified that it is extremely important for a judge hearing, for example, a criminal case, to gain confidence in the proof of the fact of committing a crime precisely by the defendant. In addition to indirect evidence, as well as relative evidence obtained with the use of achievements of the STP (through the use of a polygraph, with the use of medicines, hypnotic influence, etc.), the absolute evidence, also based on the achievements of the STP, is fundamentally important for the judge. In the author’s opinion, these are – in development – active and widely used: method of fingerprinting, the method of DNA analysis, and not yet valid and even not invented method of mentoscopy. The initial postulate of which is the fact that all information received through the receptors of a person’s sense organs is preserved in the «depths» of his memory and a technical (potentially) possibility, with observance of a number of conditions, to reproduce its part in the interests of justice.
