Proceeding on Cases with Participation of Foreign Persons in International Procedure Law of Russia, Kazakhstan and Uzbekistan

This article is dedicated to one of the most interesting aspects of International Procedure Law – litigation with the participation of foreign persons. Authors focused on a comparative analysis of Russian, Kazakh and Uzbek legislation concerning the regulation of international procedural relations. Article includes two paragraphs: the first one considers international jurisdiction of Russian arbitrazh courts, Kazakh economic courts and Uzbek economic courts on commercial matters; the second one examines the recognition and enforcement of foreign court decisions in commercial matters on the territory of Russia, Kazakhstan and Uzbekistan. Authors deeply scrutinized a wide range of legal documents including domestic legislation and multilateral international treaties of regional character in order to show the convergences and divergences in Russian, Kazakh and Uzbek procedural law concerning participation of foreign persons in international commercial litigation.

В настоящей статье рассматривается понятие категорий иностранных инвестиций и иностранного инвестора в международном инвестиционном праве России и Грузии через призму трех уровней правового регулирования - национального законодательства, двусторонних и многосторонних международных договоров. Национальное законодательство, регулирующее иностранные инвестиции, хотя и основывается на общеупотребимых правовых конструкциях и инструментах, в рамках понятийного аппарата может существенно отличаться в государстве - реципиенте иностранных инвестиций и в государстве происхождения иностранного инвестора. Данное обстоятельство полностью применимо к законодательству России и Грузии, одновременно являющихся участницами интеграционного процесса в рамках ОЧЭС.

Categories of foreign investments and foreign investor in the national legislation and international treaties of the member states of the Eurasian Economic Union

В статье рассматривается понятие категорий иностранных инвестиций и иностранного инвестора в праве государств – членов ЕАЭС через призму трех уровней правового регулирования: национального законодательства, двусторонних и многосторонних международных договоров. Национальное законодательство государств – членов ЕАЭС, регулирующее иностранные инвестиции, хотя и основывается на общеупотребимых правовых конструкциях и инструментах, в рамках понятийного аппарата может существенно отличаться в государстве – реципиенте иностранных инвестиций и в государстве происхождения иностранного инвестора, что требует пристального внимания и детального исследования нормативных правовых актов каждого государства – члена ЕАЭС. Наряду с нормами, регулирующими иностранное инвестирование и статус иностранного инвестора в рамках евразийского права, государства – члены ЕАЭС применяют нормы двусторонних договоров о поощрении и защите капиталовложений, действующих не только между ними, но и с третьими государствами. Кроме этого для четырех государств – членов ЕАЭС действует и многосторонний международный договор, а именно Московская конвенция СНГ. Данное обстоятельство обусловлено участием России, Армении, Беларуси, Казахстана и Кыргызстана одновременно в трех интеграционных процессах – в рамках ЕАЭС, СНГ и ШОС.
