social state is defined as using of political (state) power with the aim to establish some kind of social justice. According to representatives of the conservative circles of capital social functions of the state lead to suppression of individual liberty and private initiative, to communist or fascist dictatorship. In modern russian legal literature these ideas are propagated by the adherents to so called libertarian theory of law and state
