- Abstract
- The article covers issues of the constitutional development of Abkhazia in connection with the declaration of independence, its constitutional legitimation. Considering main prerequisites and factors of establishment of the Abkhazian statehood, the author notes the importance of political and legal practice, impact of the state-legal theory on these processes. The author also gives an overview of the modern condition of the state-legal system of the Republic of Abkhazia. The mission of the state (constitutional) law of Abkhazia is seen as a process of creation and establishment of state institutions and the legal status of a citizen. All this should ensure stability and prospects of the Abkhazian state, the worthy level of civil society development and living of Abkhazian citizens. At the same time, according to the author, the Abkhazian State and Law is yet to substantiate the stature of many state and legal institutions, to reveal their significance and above all to form these institutions as an effectively functioning system of state power. Regarding the Republic of Abkhazia the article considers the theory of 3 elements of the state (territory, power, population).
