- Abstract
- chose in action - not a typical object of pledge, which is becoming more popular nowadays. In this paper we propose to consider a chose in action as a fiction of the object of right to remove a logical contradiction inherent in the construction of "the right of pledge on the chose in action". This article discusses points of view of different scientists at the institute of pledge of chose in action - from complete denial to analysis the theories, explaining its essence. There is also a pre-revolutionary, soviet and modern legislator attitude to the pledging of chose in action. We investigate the doctrine, legal practice and bills connected with the pledge of chose in action.
