Abstract

The author analyses decisions of Russian courts of common jurisdiction and state arbitration courts in 2010-2012 in which the courts made references to the Constitution of the Russian Federation. The situations of implementation of the Constitution are summarized and classified. Solution of some theoretical problems of direct effect of the Constitution in the Russian legal system is suggested on the basis of the analysis.
