- Abstract
- Annotation: the article considers the possibility of protection by the proprietor's right at illegal (arbitrary) capture of premises belonging to him/her/it. The changes which have occurred in the Housing code of the Russian Federation after March 1st, 2005, do not allow to make it, basing on the housing legislation. Today the unique possibility for the proprietor to protect the right to housing is given by the Civil Code of the Russian Federation. The protection itself, thus, occurs by recovery - demanding property from another's illegal possession in a judicial order.
