- Abstract
- Legalization of various forms of cohabitation in some foreign countries labeled the problem of revising the categories of " family” and " marriage” that are essential to society and family law. The article analyzes the proposal to legalize cohabitation, expressed in the publications of the Russian authors. In this regard, the author proposes interpretation of "traditional” marriage as a model union of man and woman needed for self-preservation and cultural development of society. From this perspective, marriage is the foundation of the family and has the legal protection of the state. In work the concepts of marriage used in the right are differentiated. The author opens features of marriage as the social institute "sui generis” defining features of legal regulation of the family relations and formation of family and legal institute of marriage in Russia.
