Abstract
The work on the basis of conceptual conclusions presents the definition and the defining characteristics of the military organization, with changes in the legislation regulating the legal status of state (municipal) institutions, which include military organization with a status of a legal entity. Due to the fact that commercial activities may not meet the basic purpose of activity of military organizations, and staffed by persons of commercial organizations contradicts to the purpose of military service, the author presents the point of view that such enterprises subordinate to the Ministry of Defense, of the Russian Federation should not be considered as military organizations.
