the article discusses the concept of “good faith” and “reasonableness” as the characteristics of the subject of the relationship and his behavior. The authors propose to start from the new approaches of the Civil Code of the Russian Federation to the evaluation of the conduct of the parties: the party to the contract should be exempt from civil liability if its actions to implement the commitments was reasonable and in good faith.
