- Abstract
- The subject of study in this article are the constitutional duty of the State to recognize, respect and protect the rights and freedoms of man and citizen in the Russian Federation. The author gives a constitutional and legal description of each of these responsibilities and identifies the relationships between them. Stand species recognition by the state of human rights and freedoms of man and citizen: direct and indirect. Attention is paid to issues of concern definition of the subject composition of persons obliged to respect the rights and freedoms of man and citizen, as well as issues of efficiency performance of the state duty to protect human rights and freedoms. The author come to conclusions about the interrelationship constitutional obligations to recognize, respect and protect the rights and freedoms of man and citizen, on the inadmissibility of violating the sovereignty of the state and legal system in Russia in the process of state recognition of the rights and freedoms of man and citizen, the significant role of the judicial system in the implementation of the obligation to protect the rights and freedoms of man and citizen in the Russian Federation.
