Abstract

Предметом данной статьи являются гражданско-правовые нарушения исключительных прав при осуществлении экспортно-импортных операций. На основе сравнения опыта РФ, ФРГ и ЕС исследованы вопросы локализации гражданско-правового нарушения исключительных прав, установления нарушителя исключительных прав и соотношения сферы действия вещного статута, статута договора, статута интеллектуальных прав in rem и статута деликтных обязательств.
