Abstract

The article examines the principles of adversary and equality of participants according to the legal positions of the Constitutional Court when verifying the constitutionality of criminal procedure law provisions. The doctrinal interpretation of adversarial principle is also given. Importance of legal positions of the Constitutional Court in the implementation of adversarial principle and the democratic basis ofjudicial proceedings is emphasized.
