- Abstract
- The research contains the results of author’s critical reflection of the orthodox approaches, which are in use in the Russian jurisprudenceto verify the property phenomenon. Authoruses axiological methodologyto confirm the thesis that the property conceptions, which are commonly used in philosophy, sociology and other liberal arts, are objectively inappropriate for the purposes of jurisprudence and legal analysis. Author suggests to applyin the modern legal researches of the property rights the entity of the socially accepted (legal) interest, concentrating that part ofpersonal liberties and intentions, which fits to the socially accepted moral basics of law in consideration of the specified groups of social relations.
