Abstract

The components of free choice of arbitrators and arbitration procedures from the point of view of the philosophy of arbitration of disputes, which began to emerge in the post-Soviet legal space after the adoption of national laws regulating the order of formation and activities of arbitration courts are considered in the article. The problems of providing greater independence to disputing parties in the choice of law applicable to the legal relations that have arisen are considered. It is proposed to orientate in the practice of arbitration proceedings on the experience of countries that have developed traditions of arbitration of disputes.
