- Аннотация
В статье поднимается актуальный вопрос раскрытия информации о наличии и природе интеллектуальных прав в отчетности публичных компаний. Основным недостатком, выявленным по итогам анализа практики и правовых рамок, установленных китайскими регуляторами, является отсутствие упорядоченности в содержании системных норм.
Публичные компании КНР часто интерпретируют положения регуляторов в своих коммерческих интересах. Для создания более совершенной правовой системы предлагается создать более четкую и ясную структуру документов раскрытия, создать реестровую систему фактов раскрытия информации об интеллектуальной собственности.
Опыт КНР целесообразно использовать при создании более совершенной системы раскрытия информации российскими публичными и непубличными компаниями, поскольку наблюдаются схожие проблемы.
